Workplace Mediation

Positive about your future

Mediation or Alternative Dispute Resolution (ADR) has developed over recent years to be an effective way of resolving workplace disputes, stalements and impasses without involving the Court or the Tribunals.

Mediation is now an established part of the UK Court and Tribunal system. The law now requires you to have considered alternative dispute resolution (ADR) before commencing court/ tribunal proceedings.

Mediation is especially effective when used at an early point in a workplace disagreement. Early mediation can prevent both sides from becoming entrenched and the difference turning into a full-blown dispute. If the disagreement can be resolved there is less chance of the working relationship irrecoverably breaking down. Mediation can help in maintaining good and productive employment.

Mediation involves an independent mediator, who helps both sides resolve their problems.

'A lot is gained from people talking about their problems before an employee with a grievance goes to a solicitor'

Mediation is a voluntary process and will only take place, if both participants agree. By agreeing to mediation you retain control of the outcome. The process does not start until a mediation agreement has been signed.

Mediation allows the parties to find their own solutions, rather than risk the uncertain outcome of litigation.

'Too much formalisation leads to escalation of problems'

Mediation is more likely to enable the employer to get beneath the problem and make changes.

'There is growing awareness in HR of the benefits of workplace mediation'

Civil and Commerical Mediation can be a quick and cost effect method in dealing with problems. Whilst at the same time retaining or rebuilding employment relationships.
